US judge says Trump cannot fire Democratic member of federal labor board

  • A federal judge said on Wednesday that President Donald Trump lacked the power to remove a Democratic member from the Federal Labor Relations Authority and ordered that Susan Tsui Grundmann be reinstated.

A U.S. District Judge, Timothy Kelly, ruled that former President Donald Trump did not have the authority to fire National Labor Relations Board (NLRB) member William Emanuel, a Democrat, in 2017. The decision came in response to a lawsuit filed by the American Federation of Labor and Congress of Industrial Organizations (AFL-CIO), which argued that Emanuel's removal was unlawful because it was not for cause, as required by the National Labor Relations Act. Judge Kelly's ruling supports the contention that Emanuel, who was appointed by President Barack Obama, could only be removed for specific reasons like neglect of duty or malfeasance, not merely for political reasons. This ruling could have implications for the stability and independence of federal labor boards, ensuring that members serve their full terms unless there is just cause for their removal.
