A federal judge in Texas has declined to immediately block the U.S. Department of Labor's new rule that would allow retirement plans to consider environmental, social, and governance (ESG) factors in investment decisions. This decision came in response to a lawsuit filed by 25 Republican-led states, who argue that the rule, which reverses a Trump-era policy, violates federal benefits law by potentially prioritizing political agendas over financial returns. The rule, set to take effect on January 30, 2023, aims to give fiduciaries more flexibility to consider ESG factors alongside traditional financial metrics. The states sought a preliminary injunction to halt the rule, but U.S. District Judge Matthew Kacsmaryk, an appointee of former President Donald Trump, decided not to issue an immediate block, stating that the states failed to demonstrate they would suffer irreparable harm without an injunction. However, he indicated that the case would proceed to a full hearing on the merits.
