  • A Wisconsin judge overturned a state law that prevented public employees from collective bargaining Monday. The legislation, known as Act 10 and passed in 2011 under former Gov. Scott Walker (R), was declared unconstitutional.

A Wisconsin judge has ruled that a 2011 law, known as Act 10, which significantly curtailed the collective bargaining rights of most public employees, is unconstitutional. This law, championed by former Governor Scott Walker, limited bargaining to base wages and required unions to hold annual recertification votes. The decision by Dane County Circuit Judge Jacob Frost found that the law violated the state's equal protection guarantee by treating different public employee unions unequally. Specifically, the law exempted certain public safety workers like police and firefighters, who supported Walker, while impacting other public sector unions. This ruling could potentially reinstate full bargaining rights for teachers, nurses, and other public workers, although an appeal from Republican lawmakers is expected.
