DHS overhauls H-1B visa program

The Department of Homeland Security (DHS) has announced a significant overhaul of the H-1B visa program, aimed at enhancing efficiency, reducing fraud, and improving the overall process for both employers and foreign workers. Key changes include the introduction of a beneficiary-centric selection process where each applicant is entered into the lottery only once, regardless of multiple registrations by different employers, to ensure a fairer selection. Additionally, the rule expands eligibility for cap-exempt H-1B petitions, allowing certain organizations to file petitions without being subject to the annual cap. The DHS also plans to implement new measures to combat fraud, such as requiring valid passport or travel document information during registration. These reforms are part of a broader effort to modernize the immigration system, making it more responsive to economic needs and reducing administrative burdens. The changes are set to take effect for the fiscal year 2025 H-1B cap season, with some provisions starting immediately upon publication in the Federal Register.
