  • Office of the Inspector General (OIG) has revealed that DOJ personnel misled courts in order to obtain gag orders that prevented dozens of elected officials and Congressional staffers from knowing they were being spied on during the Russiagate investigation.

The Department of Justice (DOJ) improperly obtained surveillance warrants to spy on members of Congress and their staff during the investigation into Russian interference in the 2016 election, according to a report by the DOJ's Office of the Inspector General. The report, released on May 15, 2023, found that the FBI misled the Foreign Intelligence Surveillance Court (FISC) by providing inaccurate or incomplete information in applications for surveillance under the Foreign Intelligence Surveillance Act (FISA). This misconduct included not disclosing exculpatory information and misrepresenting facts about the targets, which included a U.S. Senator and at least one congressional staff member. The errors were attributed to systemic issues within the FBI's handling of FISA applications, highlighting significant lapses in oversight and accountability. The findings have raised concerns about the integrity of the surveillance process and the potential infringement on the rights of American citizens, particularly those in sensitive political positions.
